Asimismo se efectuaron algunas modificaciones a la Ley de Contrato de Trabajo 20.744.
Se modificó el cálculo de movilidad de las prestaciones establecido en el art. 32 de la ley 24.241. La movilidad se basará en un setenta por ciento (70%) en las variaciones del Nivel General del Índice de Precios al Consumidor Nacional elaborado por el Instituto Nacional de Estadística y Censos (INDEC) y en un treinta por ciento (30%) por el coeficiente que surja de la variación de la Remuneración Imponible Promedio de los Trabajadores Estables (RIPTE), conforme la fórmula que se aprueba en el Anexo de la presente ley, y se aplicará trimestralmente en los meses de marzo, junio, septiembre y diciembre de cada año calendario. La primera actualización se hará efectiva a partir del 1° de marzo de 2018.

Asimismo, se modificó el art. 252 de la Ley de Contrato de Trabajo 20.744 incorporándose como requisito la edad de 70 años del trabajador para efectuar la intimación por parte del empleador a iniciar los trámites jubilatorios a aquellos empleados que se encuentren en condiciones de hacerlo.

Ley:
Capítulo I
Índice de Movilidad Jubilatoria
ARTÍCULO 1º.- Sustitúyese el artículo 32 de la ley 24.241 y sus modificaciones, el que quedará redactado de la siguiente forma:
Artículo 32: Movilidad de las prestaciones.
Las prestaciones mencionadas en los incisos a), b), c), d), e) y f) del artículo 17 de la ley 24.241 y sus modificaciones, serán móviles.
La movilidad se basará en un setenta por ciento (70%) en las variaciones del Nivel General del Índice de Precios al Consumidor Nacional elaborado por el Instituto Nacional de Estadística y Censos (INDEC) y en un treinta por ciento (30%) por el coeficiente que surja de la variación de la Remuneración Imponible Promedio de los Trabajadores Estables (RIPTE), conforme la fórmula que se aprueba en el Anexo de la presente ley, y se aplicará trimestralmente en los meses de marzo, junio, septiembre y diciembre de cada año calendario.
En ningún caso la aplicación de dicho índice podrá producir la disminución del haber que percibe el beneficiario.
ARTÍCULO 2°.- La primera actualización en base a la movilidad dispuesta en el artículo 1° de la presente, se hará efectiva a partir del 1° de marzo de 2018.
ARTÍCULO 3º.- Sustitúyese el artículo 2º de la ley 26.417 el que quedará redactado de la siguiente forma:
Artículo 2º: A fin de practicar la actualización de las remuneraciones a las que se refiere el artículo 24, inciso a) y las mencionadas en el artículo 97 de la ley 24.241 y sus modificaciones, se aplicará un índice combinado entre el previsto en el inciso b) del apartado I del artículo 5° de la ley 27.260 y su modificatorio y el índice establecido por la Remuneración Promedio de los Trabajadores Estables.
ARTÍCULO 4º.- Encomiéndase a la Secretaría de Seguridad Social del Ministerio de Trabajo, Empleo y Seguridad Social, a realizar el cálculo trimestral de la movilidad y su posterior publicación.
Capítulo II
Haberes Mínimos Garantizados
ARTÍCULO 5º.- Incorpórase como artículo 125 bis de la ley 24.241 y sus modificaciones el siguiente:
Artículo 125 bis: El Estado nacional garantiza a los beneficiarios de la Prestación Básica Universal (PBU) que acrediten treinta (30) años o más de servicios con aportes efectivos, el pago de un suplemento dinerario hasta alcanzar un haber previsional equivalente al ochenta y dos por ciento (82%) del valor del Salario Mínimo Vital y Móvil, instituido por el artículo 116 de la Ley de Contrato de Trabajo 20.744 (t.o. 1976) y sus modificatorias vigente en cada período.
La presente garantía no resulta aplicable a los beneficiarios que hubiesen accedido a la Prestación Básica Universal por aplicación de la ley 24.476 modificada por el decreto 1.454 del 25 de noviembre de 2005, por el artículo 6º de la ley 25.994 o por la ley 26.970, todas ellas con las modificaciones introducidas por los artículos 20 a 22 de la ley 27.260.
ARTÍCULO 6º.- La Secretaría de Seguridad Social del Ministerio de Trabajo, Empleo y Seguridad Social establecerá las pautas de aplicación relativas a la liquidación del suplemento previsto en el artículo 5º de la presente.
Capítulo III
Facultad del empleador para intimar al trabajador a jubilarse
ARTÍCULO 7º.- Sustitúyese el artículo 252 de la Ley de Contrato de Trabajo 20.744 (t.o. 1976) y sus modificatorias el que quedará redactado de la siguiente forma:
Artículo 252: A partir de que el trabajador cumpla setenta (70) años de edad y reúna los requisitos necesarios para acceder a la Prestación Básica Universal (PBU) establecida en el artículo 17, inciso a) de la ley 24.241 y sus modificaciones, el empleador podrá intimarlo a que inicie los trámites pertinentes, extendiéndole los certificados de servicios y demás documentación necesaria a esos fines. A partir de ese momento, el empleador deberá mantener la relación de trabajo hasta que el trabajador obtenga el beneficio y por un plazo máximo de un (1) año.
Lo dispuesto en el párrafo precedente no afecta el derecho del trabajador de solicitar el beneficio previsional con anterioridad al cumplimiento de los setenta (70) años de edad.
Concedido el beneficio o vencido dicho plazo, el contrato de trabajo quedará extinguido sin obligación para el empleador del pago de la indemnización por antigüedad que prevean las leyes o estatutos profesionales.
La intimación a que se refiere el primer párrafo de este artículo implicará la notificación del preaviso establecido por la presente ley o disposiciones similares contenidas en otros estatutos, cuyo plazo se considerará comprendido dentro del término durante el cual el empleador deberá mantener la relación de trabajo.
ARTÍCULO 8º.- A partir de que el trabajador reúna los requisitos necesarios para acceder a la Prestación Básica Universal (PBU) establecida en el artículo 17, inciso a) de la ley 24.241 y sus modificaciones, el empleador deberá ingresar los aportes del trabajador y con respecto a las contribuciones patronales, únicamente aquellas con destino al Régimen Nacional de Obras Sociales de la ley 23.660 y sus modificaciones y las cuotas del Régimen de Riesgos del Trabajo de la ley 24.557 y sus modificaciones.
ARTÍCULO 9º.- Incorpórase como último párrafo del artículo 253 de la Ley de Contrato de Trabajo 20.744 (t.o. 1976) y sus modificatorias el siguiente:
También es aplicable lo dispuesto por el presente artículo al trabajador que sigue prestando servicios sin interrupción a las órdenes del mismo empleador, luego del goce del beneficio de la jubilación, considerándose la fecha del acuerdo de la prestación como inicio del cómputo de la antigüedad posterior al mismo.
ARTÍCULO 10.- Quedan excluidos de lo establecido en este Capítulo, los trabajadores del sector público aunque los organismos en los que presten servicios se rijan por la Ley de Contrato de Trabajo 20.744 (t.o. 1976) y sus modificatorias.
Capítulo IV
Disposiciones Finales
ARTÍCULO 11.- La presente medida entrará en vigencia el día siguiente de su publicación en el Boletín Oficial.
ARTÍCULO 12.- Comuníquese al Poder Ejecutivo nacional.
