Ley 27384
Modificación.
El Senado y Cámara de Diputados de la Nación Argentina reunidos en Congreso, etc. sancionan con fuerza de
Ley:
ARTÍCULO 1°.- Sustitúyese el artículo 23 del Código Procesal Penal de la Nación, aprobado por ley 23.984 y sus modificatorias, por el siguiente:
Competencia e integración de la Cámara Nacional de Casación en lo Criminal y Correccional de la Capital Federal
Artículo 23.- La Cámara Nacional de Casación en lo Criminal y Correccional de la Capital Federal juzga de los recursos de inconstitucionalidad, casación y revisión.
Los jueces de la Cámara de Casación actuarán de manera unipersonal únicamente en el conocimiento y decisión:
1°) De las cuestiones de competencia.
2°) De los recursos interpuestos contra las resoluciones adoptadas en los supuestos del Libro II, Título IV, Capítulo III de este Código.
3°) De los delitos reprimidos con pena no privativa de la libertad y aquellos de acción privada.
4°) De las cuestiones de excusación o recusación.
5°) De los supuestos del Libro III, Título II, Capítulo IV, de este Código.
Para el caso de corresponder la integración unipersonal, el Presidente del Tribunal procederá al sorteo de la causa entre los tres (3) magistrados, según el ingreso de las causas y bajo un sistema de compensación, de forma tal que la adjudicación sea equitativa.
Para los restantes casos, intervendrán tres (3) jueces, no obstante lo cual podrá dictar resolución válida mediante el voto coincidente de dos (2) de ellos.
ARTÍCULO 2°.- Incorpórase como artículo 24 bis al Código Procesal Penal de la Nación, aprobado por ley 23.984 y sus modificatorias, el siguiente:
Integración de la Cámara de Apelación
Artículo 24 bis.- Los jueces de la Cámara de Apelación actuarán de manera unipersonal únicamente en el conocimiento y decisión:
1°) De las cuestiones de competencia.
2°) De los recursos interpuestos contra las resoluciones adoptadas en los supuestos del Libro II, Título IV, Capítulo III de este Código.
3°) De los delitos reprimidos con pena no privativa de la libertad y aquellos de acción privada.
4°) De las cuestiones de excusación o recusación.
Para el caso de corresponder la integración unipersonal, el Presidente del Tribunal procederá al sorteo de la causa entre los tres (3) magistrados, según el ingreso de las causas y bajo un sistema de compensación, de forma tal que la adjudicación sea equitativa.
Para los restantes casos, intervendrán tres (3) jueces, no obstante lo cual podrá dictar resolución válida mediante el voto coincidente de dos (2) de ellos.
ARTÍCULO 3°.- Sustitúyese el artículo 30 bis del Código Procesal Penal de la Nación, aprobado por ley 23.984 y sus modificatorias, por el siguiente:

Artículo 30 bis.- La Cámara Federal de Casación Penal juzga de los recursos de inconstitucionalidad, casación y revisión interpuestos contra la sentencia y resoluciones dictadas por los Tribunales Orales en lo Criminal Federal con asiento en la Capital Federal y en las provincias, la Cámara Nacional de Apelaciones en lo Criminal y Correccional Federal de la Capital Federal y las cámaras federales de apelaciones con asiento en las provincias, jueces nacionales en lo criminal y correccional federal de la Capital Federal y jueces federales de primera instancia con asiento en las provincias y tribunales orales y Cámara Nacional de Apelaciones en lo Penal Económico, respectivamente. Tiene competencia territorial en toda la República considerada a este efecto como una sola jurisdicción judicial. Asimismo, entiende en los casos previstos en el artículo 72 bis de la ley 24.121.
Los jueces de la Cámara Federal de Casación Penal actuarán de manera unipersonal únicamente en el conocimiento y decisión:
1°) De las cuestiones de competencia.
2°) De los recursos interpuestos contra las resoluciones adoptadas en los supuestos del Libro II, Título IV, Capítulo III de este Código.
3°) De los delitos reprimidos con pena no privativa de la libertad y aquellos de acción privada.
4°) De las cuestiones de excusación o recusación.
5°) De los supuestos del Libro III, Titulo II, Capítulo IV de este Código.

ARTÍCULO 6°.- Los fiscales y defensores que se desempeñan ante la Cámara Nacional de Apelaciones en lo Criminal y Correccional, la Cámara Nacional de Apelaciones en lo Criminal y Correccional Federal de la Capital Federal, las Cámaras Federales de Apelaciones con asiento en las provincias, la Cámara Federal de Casación Penal y la Cámara Nacional de Casación en lo Criminal y Correccional de la Capital Federal, respectivamente, lo harán manteniendo sus equipos de trabajo, tanto si dichas Cámaras actúan como tribunal unipersonal o como tribunal colegiado.
El Ministerio Público Fiscal y el Ministerio Público de la Defensa, en el ejercicio de sus respectivas competencias, tomarán las medidas conducentes para atender las necesidades que la implementación de la presente ley requiera.
ARTÍCULO 7°.- Las erogaciones necesarias para la implementación de la presente ley se imputarán al presupuesto correspondiente al Poder Judicial de la Nación.
ARTÍCULO 8°.- La presente ley entrará en vigencia el día siguiente al de su publicación oficial y su implementación se efectuará de conformidad con el cronograma que establezca la Comisión Bicameral de Monitoreo e Implementación del Nuevo Código Procesal Penal de la Nación que funciona en el ámbito del Honorable Congreso de la Nación, previa consulta al Ministerio de Justicia y Derechos Humanos a través de la Secretaría de Justicia y al Presidente del Consejo de la Magistratura.
ARTÍCULO 9°.- Comuníquese al Poder Ejecutivo nacional.
