Apruébase el Reglamento de la Dirección de Control y Asistencia de Ejecución Penal.
Buenos Aires, 26/09/2017
Expte. N° 3478/14
En Buenos Aires, a los 26 días del mes de septiembre del año dos mil diecisiete, los señores Ministros que suscriben la presente,
CONSIDERARON:
I) Que en cumplimiento de lo dispuesto en el punto 2° de la Acordada 17/2015, los señores Presidentes de cámara que integran la Comisión de Supervisión de la “Dirección de Control y Asistencia de Ejecución Penal” -creada por ley 27.080- han elevado un nuevo proyecto de reglamento de la mencionada dirección.
II) Que con el loable propósito de atender al carácter de auxiliar de la justicia federal y nacional que fija la ley en su artículo 1°, la reglamentación proyectada establece que la dirección contará con tantas delegaciones como jurisdicciones federales existan, de modo que en virtud de que en materia penal el territorio nacional se encuentra compuesto por 16 distritos judiciales, incluyendo el de la Capital (ley 24.050, art. 3 y ley 27.146, art. 15), excluida ella, en cada uno de los 15 restantes se deberían integrar las referidas delegaciones.
III) Que a los fines precedentemente señalados se reservarán de los cargos -previstos en el anexo I de la ley- los que sean indispensables para las necesidades de las cámaras con asiento en las provincias, personal que deberá ser designado por ellas, de conformidad con lo previsto en el artículo 118, inciso c) del Reglamento para la Justicia Nación, con la previa intervención o propuesta de la Comisión de Supervisión.
IV) Que sin perjuicio de lo anterior, por el momento, con la organización central se atenderán las necesidades correspondientes a las cámaras de Capital y de las más próximas de la provincia de Buenos Aires (La Plata, San Martín y Mar del Plata), hasta que se habiliten las delegaciones según el orden de prioridades que fije la Comisión de Supervisión.
V) Que, en otro aspecto, procede precisar que los integrantes del Consejo Consultivo que asesorarán a la Dirección -previsto en el art. 2° in fine de la ley- se desempeñarán “ad hoc” y “ad honorem”, sin que ello ocasione ningún tipo de erogación.
VI) Que por último, la Comisión de Supervisión evaluará si razones del mejor servicio de justicia indican la conveniencia de mantener -provisoriamente- la afectación del personal del Poder Judicial de la Nación, que cumpla similares tareas, al cumplimiento de las funciones establecidas en el artículo 3° de la ley, según lo previsto en el punto 4° de la Acordada n° 17/2015.
Por ello,
ACORDARON:
1°) Aprobar el Reglamento de la “Dirección de Control y Asistencia de Ejecución Penal”, que como Anexo forma parte integrante de la presente, según lo expuesto en los considerandos de esta acordada.
En virtud de lo anterior y lo dispuesto en el punto 5° de la Acordada 17/2015, la Cámara Federal de Casación Penal se encuentra facultada para designar en forma definitiva al personal que por esa decisión se desempeña interinamente.
2°) Hágase saber a las cámaras Federal de Casación Penal, Nacionales de Casación en lo Criminal y Correccional de Capital, de Apelaciones en lo Criminal y Correccional Federal, y en lo Penal Económico y a las cámaras federales del interior del país, a fin de que comuniquen a los magistrados de cada jurisdicción los términos de la presente.
