Buenos Aires, 3 de Marzo de 2017.-
I. La Sra. jueza de primera instancia hizo lugar parcialmente a la demanda interpuesta por la Sra. Delia Beatriz Fistolera y condenó a Edesur S.A. al pago de $ 13.000.-, con más sus intereses y costas; ello, en concepto de indemnización por el corte de suministro de energía eléctrica que sufrió la actora desde el año 2005, resaltando los cortes de diciembre de 2010, diciembre de 2013, enero y febrero de 2014, entre otros (fs. 167/198). La actora, única parte que recurre, cuestiona los montos de $ 3.600.- por daño material, de $ 5.400.- por daño moral, y de $ 4.000.- por daño punitivo, reconocidos en la sentencia. Para fundar sus agravios evalúa la magnitud de las horas de corte del servicio, las molestias y los daños ocasionados de acuerdo a las condiciones de espacio, tiempo y lugar en que los hechos causantes de la acción se sucedieron. Sobre el daño punitivo, analiza la situación de la empresa prestataria y la naturaleza de la norma que la fija como una sanción con fines disuasivos para evitar las acciones u omisiones que provocan al consumidor las deficiencias en la prestación del servicio de suministro de energía eléctrico. Cita jurisprudencia de esta Sala en la que se fijaron valores sustancialmente distintos a los estimados en la instancia de grado
II.- En punto al “daño material”, debe tenerse presente que al margen de las expresiones vertidas por los recurrentes al punto III de la pieza de fs. 180 vta. /20181, de las constancias de autos surge que no se produjo prueba alguna que amerite modificar el monto otorgado por el señor Juez. En ese sentido, y aun cuando la efectiva existencia de erogaciones materiales derivadas del incumplimiento de la demandada se encuentran probadas mediante las declaraciones testimoniales obrantes a fs. 140/201, lo cierto es que en concreto respecto de la cuantía de aquél daño no queda otra alternativa que estimarla con la herramienta que suministra el art. 165 del Código Procesal. En tales condiciones, teniendo en cuenta las pautas que surge de los antecedentes jurisprudenciales de esta Sala (vgr. consultar causa 7.515/2011del 16.03.15) y ponderando la extensión del corte de suministro de la energía eléctrica reconocida en la anterior instancia que no ha merecido agravio alguno (confr. fs. 124/20126 vta,), como así mismo que aquel incumplimiento fue reiterado en distintas oportunidades en el transcurso de los años 2005 a 2015 durante –entre otros- períodos comprendidos en las festividades de fin de año (426 horas en total), se estima la suma por el rubro daño material en CUATRO MIL PESOS ($ 4.000).
III.- Respecto de la reparación al daño moral, es dable recordar que esta indemnización reviste carácter resarcitorio (conf. causas 5643 del 8.8.00, 3540 del 21.12.00, 5348 del 17. 12.00, 2784 del 19.7.03 y 7.515/2011 cit.) y el caso se rige por el art. 522 del Cód. Civ., aplicable a supuestos de inejecución contractual, lo cual exige apreciar las circunstancias que rodearon el incumplimiento (Sala I, causas 5162 del 17/195/1988 y 7568/1992 del 3/2010/1995; y Sala II, causa 11.701/1995 del 9/199/1997). En este punto, debe tenerse en cuenta que la prestación defectuosa del servicio eléctrico se prolongó en forma efectiva durante varios días, en distintos períodos del año. Frente a estas pautas, las molestias e incomodidades que la interrupción del suministro eléctrico ocasionó a la parte actora para su vida, con el agravante de que la actora vivía en el piso 12 -por lo que debió acceder a su hogar por escalera varias veces por día-, sumado a que los cortes más extensos se produjeron en los meses de diciembre y enero, con calores sofocantes propios de la época, sin poder acceder a ningún sistema de refrigeración; estimo reducida la suma otorgada en la anterior instancia y propicio elevarla a la cantidad de CATORCE MIL PESOS ($ 14.000.-). Además, tengo en cuenta para postular el incremento de la cantidad asignada en la instancia anterior, que los testigos han acreditado la situación anímica de la actora como consecuencia de la interrupción del servicio (ver. fs. 7/198), declaraciones no observadas por la concesionaria Edesur S.A.).
Por otra parte, es indudable que la especial época en que se produjeron algunos cortes, aproximándose las festividades navideñas y de fin de año, con la incertidumbre propia de no poder planear posibles reuniones y encuentros sociales y familiares, tuvo entidad suficiente para potenciar la afectación espiritual (esta Sala II, 7.515/2011del 16.03.15, cit.)
VI.- La accionante también se agravia de que no se le haya admitido una indemnización en concepto de daño punitivo. Se ha sostenido respecto de esa novedosa categoría jurídica que, en tanto no tiende a resarcir un daño sino a causar un mal al responsable del ilícito con fines de sanción y de prevención general, tiene la naturaleza de pena (PICASSO, Sebastián “Sobre los denominados “Daños Punitivos” LL 2007-F, 1154). Con motivo de ello, cuando de daño punitivo se trata, el juzgador no puede desatender la posición del autor del daño, pues será en este incumplimiento donde finque la verdadera causa de la procedencia del rubro. Por otra parte, debemos considerar que este tipo de daños se proyecta en sumas de dinero que los tribunales mandan a pagar a la víctima de ciertos ilícitos, que se adicionan a las indemnizaciones por daños realmente experimentados por el damnificado y que están destinados a punir graves inconductas del demandado.
En consonancia con ello, la naturaleza de pena que reviste el instituto en cuestión, implica una evaluación más exhaustiva por parte del Juez al momento de aplicar el instituto, atendiendo la gravedad del hecho generador, pues no cualquier incumplimiento contractual o legal puede dar curso a la petición de este tipo de pena que condena al incumplidor a reparar más allá del daño producido (conf. COLOMBRES, Fernando Matías, “Los daños punitivos en la Ley de Defensa del Consumidor”, La Ley, publicado el 16/2009/2008). Ahora bien, más allá de la criticada técnica legislativa utilizada en la redacción del art. 52 bis de la Ley N°24.240, no puede desconocerse que la incorporación del daño punitivo, se revela como un instituto necesario a la hora de poner coto a las conductas desaprensivas por parte de los proveedores que generen perjuicios a los usuarios de los servicios que prestan.
Y es esta actitud de excesiva displicencia, la que justifica la admisión de un rubro que no deja de revestir un carácter excepcional en el ámbito civil. Reiterase, la procedencia de este rubro no se relaciona con los daños efectivamente sufridos, sino con la conducta gravosa de quien los ha causado. Sentados así los lineamientos generales en lo relativo al instituto del daño punitivo, resulta procedente la pretensión indemnizatoria por dicho rubro atento el incumplimiento incurrido por la demandada y la duración del corte del servicio que, por otra parte, se reiteró en diversas oportunidades en el transcurso de diez años. Asiste razón a la actora cuando afirma que en la medida que a las prestatarias le resulte más económico cancelar exiguas indemnizaciones, en lugar de realizar las inversiones necesarias para brindar un servicio eficiente, los apagones continuarán, como de hecho, es público y notorio se han reiterado por varios años.
Por ello, ponderando la gravedad del incumplimiento y sus efectos, y conforme lo estipulado por el art. 47 inciso b) de la Ley N°24.240 (incorporado por el art. 21 de la Ley N°26.361), propicio reconocer la suma pretendida por la actora en concepto de daño punitivo VEINTICINCO MIL PESOS ($ 25.000.), monto que se fija a valores actuales. Se destaca que esa suma coincide con la reclamada por el apelante en su expresión de agravios (ver fs. 181 vta.). Por todo ello, debe hacerse lugar al recurso de la actora y modificarse la sentencia de grado en cuanto a las indemnizaciones por daño material y moral, elevándolas a las sumas de CUATRO MIL PESOS ($ 4.000) y CATORCE MIL PESOS ($ 14.000.-), respectivamente y, asimismo, elevar la suma reconocida por daño punitivo a la suma de VEINTICINCO MIL PESOS ($ 25.000.), monto –este último- que se establece a valores de la fecha de esta sentencia. Las sumas con causa en los daños materiales y morales, devengarán los intereses según las pautas fijadas en la sentencia de grado, es decir desde la fecha el origen de los sucesivos cortes 21.12.2010 y a la tasa activa del Banco Nación en sus operaciones habituales de descuentos a treinta días. Los intereses correspondientes a la suma reconocida por daño punitivo –eventualmente- se calcularán a esa misma tasa y comenzarán a correr desde la mora en el pago de la condena, que deberá hacerse efectiva dentro del plazo de diez días también fijado en la instancia anterior. Las costas de ambas instancias a la corresponde a las demandadas vencidas (art. 68, primera parte, Código Procesal). En virtud de lo considerado, esta sala RESUELVE:
I) Hacer lugar al recurso de la actora y se modificar la sentencia recurrida en cuanto a las indemnizaciones por daño material, elevándola a la suma CUATRO MIL PESOS ($ 4.000.-), por daño moral, elevándola la suma de CATORCE 5 MIL PESOS ($ 14.000) y la del rubro daño punitivo, a la suma de VEINTICINCO MIL PESOS ($ 25.000.), suma que se establece a valores de la fecha de esta sentencia, con más los intereses según lo considerado; con costas de ambas instancias a la demandada vencida (art. 68, primera parte, Código Procesal);
2) Disponer que una vez aprobado el monto de condena mediante liquidación, se adecuarán los honorarios (art. 279 del Cód. Procesal). La Dra. Graciela Medina no suscribe en virtud de hallarse en uso de licencia (art. 109 del R.J.N.). Regístrese, notifíquese y devuélvase.
