Por medio de la Resolución 127-E de la Secretaría de Empleo, publicada en el Boletín Oficial del 31/03/2017, se reglamentó el Programa “El Empleo en tu Barrio” creado por la Resolución del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL N° 1035/2016. El programa se instrumentará a través de Convenios de Cooperación a suscribirse por la SUBSECRETARÍA DE PROMOCIÓN DEL SECTOR SOCIAL DE LA ECONOMÓMIA con las entidades previstas por el artículo 3° de la citada resolución 1035/2016.

Programa “El Empleo en tu Barrio”. Reglamentación.
Ciudad de Buenos Aires, 17/02/2017
VISTO el Expediente N° 1.747.181/2016 del Registro del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL, la Resolución del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL N° 1035 del 12 de diciembre de 2016, y
CONSIDERANDO:
Que por la Resolución del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL N° 1035/2016 se creó el PROGRAMA “EL EMPLEO EN TU BARRIO”, el cual tiene por objeto acercar a la población a los Programas Nacionales de Empleo y al resto de las acciones del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL DE LA NACION, en acompañamiento y participación de las políticas nacionales de difusión, cercanía y proximidad incluidas en el dispositivo “EL ESTADO EN TU BARRIO” de la PRESIDENCIA DE LA NACION.
Que el PROGRAMA “EL EMPLEO EN TU BARRIO” tiene los siguientes objetivos: a) Difundir y promocionar a la población y eventuales beneficiarios de los Programas Nacionales de Empleo el funcionamiento, objetivos, la forma de inscripción, y los beneficios ofrecidos por tales políticas públicas; b) Difundir y promocionar a la población el funcionamiento de las distintas instancias de asesoramiento, denuncias, y acompañamiento en relación a la erradicación del Trabajo Infantil, la violencia laboral, y las acciones afirmativas que lleva adelante el MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL en materia de igualdad de oportunidades en el ámbito laboral; c) Difundir el funcionamiento de la RED FEDERAL DE SERVICIOS DE EMPLEO; d) Desarrollar instancias de capacitación laboral especiales para el acompañamiento por parte del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL de las políticas nacionales incluidas en el dispositivo EL ESTADO EN TU BARRIO; e) Propiciar instancias de articulación en asuntos de interés compartido con otros organismos públicos cuando la inquietud del ciudadano a quien está dirigido el Programa, así lo requiriera; f) Establecer mecanismos de registro y denuncias de empleo informal y asistencia jurídica, y g) Promocionar las políticas de Empleo Joven del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL, dándole prioridad a la realización de acciones de difusión del PROGRAMA JOVENES CON MAS Y MEJOR TRABAJO, creado por la Resolución del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL N° 497/2008, a través de la participación en Fiestas Nacionales, Regionales, Provinciales y Locales, la realización de Exposiciones, Campus, y Ferias de Empleo Joven, campañas de difusión web y físicas y toda otra acción de difusión necesaria para acompañar activamente con las herramientas del Programa mencionado el trayecto de los jóvenes hacia su primer empleo registrado.
Que el PROGRAMA “EL EMPLEO EN TU BARRIO” prevé su instrumentación a través de Convenios de Cooperación a suscribirse con organismos nacionales, provinciales o municipales, organizaciones empresariales, sindicales o del tercer sector, universidades, centros de investigación y organismos internacionales.
Que por el artículo 4° de la Resolución del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL N° 1035/2016, se establece que la SECRETARÍA DE EMPLEO será la Autoridad de Aplicación del PROGRAMA “EL EMPLEO EN TU BARRIO” y que la misma se encuentra facultada, previa intervención de la SUBSECRETARÍA DE PROMOCIÓN DEL SECTOR SOCIAL DE LA ECONOMIA, a dictar las normas complementarias, aclaratorias y/o de implementación que resulten necesarias para el cumplimiento de los objetivos del citado Programa.
Que resulta pertinente reglamentar aspectos operativos necesarios para la implementación del PROGRAMA “EL EMPLEO EN TU BARRIO”.
Que la SUBSECRETARÍA DE PROMOCIÓN DEL SECTOR SOCIAL DE LA ECONOMÍA ha tomado la intervención prevista por el artículo 4° de la Resolución del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL N° 1035/2016.
Que la presente medida se dicta en ejercicio de las facultades conferidas por el artículo 4° de la Resolución del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL N° 1035/2016.
Por ello,
EL SECRETARIO
DE EMPLEO
RESUELVE:
ARTÍCULO 1°.- Reglaméntase la implementación del PROGRAMA “EL EMPLEO EN TU BARRIO”, creado por la Resolución del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL N° 1035/2016.
ARTÍCULO 2°.- El PROGRAMA “EL EMPLEO EN TU BARRIO” se instrumentará a través de Convenios de Cooperación a suscribirse por la SUBSECRETARÍA DE PROMOCIÓN DEL SECTOR SOCIAL DE LA ECONOMÓMIA con las entidades previstas por el artículo 3° de la Resolución del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL N° 1035/2016.
ARTÍCULO 3°.- Las entidades interesadas en suscribir Convenios de Colaboración para la implementación del PROGRAMA “EL EMPLEO EN TU BARRIO” deberán estar inscriptas en el Registro de Instituciones de Capacitación y Empleo (REGICE) y contar con los antecedentes y/o la capacidad institucional, financiera y/u operativa necesaria para el cumplimiento de las acciones que se proyecten.
La SUBSECRETARÍA DE PROMOCIÓN DEL SECTOR SOCIAL DE LA ECONOMÍA será la responsable de controlar el cumplimiento de las condiciones establecidas en el párrafo precedente del presente artículo.
ARTÍCULO 4°.- Los Convenios de Cooperación para la implementación del PROGRAMA “EL EMPLEO EN TU BARRIO” podrán prever la asignación de recursos dinerarios por parte de la SECRETARÍA DE EMPLEO, siendo responsabilidad de la SUBSECRETARÍA DE PROMOCIÓN DEL SECTOR SOCIAL DE LA ECONOMÍA establecer, en tales Convenios, los rubros y conceptos financiables así como también de evaluar la razonabilidad y pertinencia de los montos a asignar.
ARTÍCULO 5°.- Los Convenios de Cooperación para la implementación del PROGRAMA “EL EMPLEO EN TU BARRIO” establecerán las obligaciones de las partes suscribientes y contendrán como mínimo:
1. un plan de trabajo conjunto;
2. un cronograma de actividades;
3. instancias de seguimiento y supervisión;
4. mecanismos de evaluación del impacto de las acciones que se realicen;
5. los rubros o conceptos a aplicar los recursos dinerarios a asignar por la SECRETARÍA DE EMPLEO, cantidad de desembolsos y las condiciones a cumplimentar para cada desembolso, cuando correspondiere;
6. un procedimiento de rendición de cuentas de los fondos recibidos, cuando correspondiere.
ARTÍCULO 6°.- Cuando se prevea la asignación de recursos dinerarios por parte de la SECRETARÍA DE EMPLEO, la SUBSECRETARÍA DE PROMOCIÓN DEL SECTOR SOCIAL DE LA ECONOMÍA, en forma previa a la suscripción del Convenio de Cooperación, dará intervención a la Dirección de Programación Financiera de Programas de Empleo y Capacitación Laboral, a fin de verificar la disponibilidad de fondos presupuestarios suficientes para atender los compromisos que se proyecten.
ARTÍCULO 7°.- Los desembolsos de fondos que se comprometan en el marco de los Convenios de Cooperación serán autorizados por la SECRETARÍA DE EMPLEO, previo informe de la SUBSECRETARÍA DE PROMOCIÓN DEL SECTOR SOCIAL DE LA ECONOMÍA que certifique el cumplimiento de las condiciones establecidas en los citados Convenios.
ARTÍCULO 8°.- Cuando los Convenios de Cooperación incluyan acciones que correspondan a materias de competencia de otras Secretarías o unidades organizativas del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL no dependientes de la SECRETARÍA DE EMPLEO, la SUBSECRETARÍA DE PROMOCIÓN DEL SECTOR SOCIAL DE LA ECONOMÍA establecerá canales de articulación y coordinación con tales dependencias a fin de garantizar su conocimiento, intervención y/o participación.
ARTÍCULO 9°.- La SUBSECRETARÍA DE PROMOCIÓN DEL SECTOR SOCIAL DE LA ECONOMÍA emitirá un informe final de las acciones que se realicen en el marco de cada Convenio de Cooperación y será la responsable de aprobar las rendiciones de cuentas de fondos recibidos que realicen las contrapartes.
ARTÍCULO 10.- Facúltase a la SUBSECRETARÍA DE PROMOCIÓN DEL SECTOR SOCIAL DE LA ECONOMÍA a aprobar los circuitos e instrumentos operativos que resulten necesarios para la aplicación de la presente medida.
ARTÍCULO 11.- Los recursos que se asignen y las acciones que se deriven de la implementación del PROGRAMA “EL EMPLEO EN TU BARRIO” estarán sujetos al sistema de control previsto por la Ley N° 24.156 de Administración Financiera y de los Sistemas de Control del Sector Público Nacional (Unidad de Auditoría Interna del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL, Sindicatura General de la Nación, y Auditoría General de la Nación).
ARTÍCULO 12.- Comuníquese, publíquese, dése a la Dirección Nacional del Registro Oficial y archívese. — Miguel Angel Ponte.
