La magistrada esgrimió que “H. no ha demostrado respeto hacia los derechos de su hija, ni tampoco hacia al tribunal, por lo que se puede decir que se trata de un contumaz”. “Ha desobedecido los mandatos judiciales, no ha concurrido al tribunal pese a las reiteradas citaciones y, consecuentemente, no ha acreditado el cumplimiento de la prestación asistencial al acreedor alimentario, conforme a la normativa vigente; vulneró así los derechos esenciales de la menor”, afirmó.
“Resulta claro que la omisión alimentaria constituye para la ley una violencia que, por la índole y modalidad, es de carácter económica, al privar reiteradamente y con continuidad de los medios básicos de subsistencia al menor de edad, y al colocar a su representante legal –en el caso, la progenitora– en la difícil situación de afrontar por sí misma toda la manutención y los gastos atinentes de la niña», enfatizó la jueza.
En la misma dirección, en la resolución, recalcó que las constancias de la causa “evidencian las reiteradas oportunidades en que H. no ha comparecido al juzgado ni se ha preocupado en acreditar su deber de cumplimiento alimentario para con su hija menor de edad, quien, a su vez, padece de una afección en su salud que merece un cuidado y atención especiales”. “La actitud que ha mantenido para con su hija se ha caracterizado por un total desinterés, indiferencia frente a sus necesidades vitales, despreocupación y ausencia de empatía”, agregó.

De acuerdo con la jueza, correspondía hacer lugar al pedido de los Ministerios Públicos Fiscal y Complementario de que se revocara la suspensión de la ejecución condicional de la pena por incumplimiento de las reglas de conducta que, en oportunidad de haber sido condenado, se le habían impuesto al imputado. Entre las obligaciones que pesaban sobre H. se encontraba la de acreditar ante el tribunal, entre los días 10 y 20 de cada mes, “el cumplimiento de la prestación alimentaria mínima e indispensable ofrecida en relación” con su hija, que había sido fijada en 1.200 pesos.
En alusión a la “semidetención o prisión discontinua” solicitadas por la Asesora Letrada Penal del Decimonoveno Turno, la magistrada argumentó que “no es posible aplicar estas modalidades, que suponen autodisciplina y cumplimiento estricto de condiciones compromisorias, a quien ha evidenciado a lo largo de este proceso contumacia e incumplimientos reiterados, no sólo de las reglas de conducta impuestas, sino también de la prestación asistencial en favor de su hija menor de edad”. En esa línea, agregó que el imputado ha puesto de manifiesto una “significativa incapacidad para aprovechar todas y cada una de las oportunidades que se le brindaron: alternativas al juicio en primer lugar, y a la pena efectiva, en segundo lugar”.
En la resolución, la jueza expresó que, según un informe de la actuaria del juzgado, fechado el 24 de octubre de este año, “H. no ha comparecido por ante esta sede ni ha acompañado comprobantes de pago de su obligación alimentaria para con su hija menor de edad después del mes de marzo del año en curso y hasta la fecha”. Tampoco “existen constancias que acrediten el cumplimiento de las condiciones impuestas” por la sentencia, “ni su concurrencia a la Dirección de Patronato del Liberado”. “Esto demuestra un claro incumplimiento de H. de las reglas establecidas (art. 27, bis, última parte del Código Penal), lo que deriva a que el tribunal deba revocar la condicionalidad de la condena, tal como también lo han solicitado los Ministerios Públicos”.

En la resolución y tras ordenar la efectiva detención del imputado, la Dra. Asimismo, también deberá receptar “instrucción específica respecto a sus deberes como padre, con un enfoque particularizado hacia el conocimiento e internalización de los derechos humanos y la perspectiva de género, especialmente en atención a los derechos de la niñez en el marco legal vigente y en función de la responsabilidad parental que le compete”. Finalmente, parte del trabajo remunerado que percibiera “deberá ser destinado al pago de la cuota alimentaria respecto de su hija”.
